Terms of Service

1. Who we are

Sellery is operated by The CreamUnion Co., Ltd., a company incorporated in the Republic of Korea.

2. The service

Sellery helps you create marketing content for your products — product detail pages, banners, product images with background removal and AI studio shots, social media posts, short videos and ad images — from the product photos and information you provide.

Features may change as we improve the service. If we remove a paid feature in a way that materially reduces what you paid for, we will tell you in advance and you may cancel.

3. Accounts

1. 1.You can sign up with an email address and password or with a supported social login. You must give accurate information and keep your login secure.
2. 2.You must be at least 18 years old, or the age of majority where you live, and use the service for your business or professional purposes.
3. 3.You are responsible for activity under your account. Tell us immediately at axlab@crea-m.com if you believe your account has been compromised.

4. Plans and credits

Paid plans are subscriptions billed monthly or annually. Each plan includes a number of credits for each billing month. Different tasks use different numbers of credits; the number is shown before you start a task.

1. 1.Credits are a usage allowance of our own software for the current billing period. They are not money, a wallet balance, stored value, a gift card, a voucher or a cash equivalent.
2. 2.Credits cannot be bought separately, transferred, sold, exchanged for cash or used outside the service.
3. 3.Unused credits do not roll over. A new allowance starts at the beginning of each billing month, and unused credits from the previous month expire at that time. For annual plans, credits are also granted month by month.
4. 4.Free credits are granted once when you sign up and expire one month after they are granted.
5. 5.If a task fails to start because of an error on our side, no credits are charged, or any credits already used are refunded automatically.

5. Payment, renewal and cancellation

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

1. 1.Prices are shown in US dollars. Paddle adds any applicable sales tax or VAT at checkout based on your location.
2. 2.Subscriptions renew automatically at the end of each billing period at the then-current price until you cancel. Paddle charges the payment method you provided.
3. 3.You can cancel at any time from your account settings or the Paddle customer portal linked in your receipt. Cancellation takes effect at the end of the current billing period. You keep access to the plan and its remaining credits until then.
4. 4.Upgrades take effect immediately; Paddle charges the prorated difference. Downgrades are handled by support and take effect at the next renewal.
5. 5.If a renewal payment fails, Paddle may retry the charge. If payment is not completed, your subscription ends and your account returns to the free tier.
6. 6.We will give you at least 30 days' notice by email before a price increase takes effect for your subscription. You can cancel before it applies.
7. 7.Refunds are described in our Refund Policy, which forms part of these Terms.

6. Your content and outputs

1. 1.You keep all rights to the photos, text and other material you upload or enter ("Your Content"). You give us a limited license to host, process and transmit Your Content only to provide the service to you, including sending it to the AI providers listed in our Privacy Policy.
2. 2.Subject to these Terms and the rights of third parties, the content the service generates for you ("Outputs") belongs to you, and you may use it commercially. Because AI can produce similar outputs for different users, we cannot guarantee that an Output is unique.
3. 3.We do not use Your Content or Outputs to train our own AI models. We send them to AI providers only through their business APIs, and only to generate your Outputs.
4. 4.If you choose to show an Output in our public gallery, you allow us to display it on our website and in our marketing for as long as it is shown. You can withdraw it from the gallery at any time.
5. 5.You must have the right to use everything you upload, including product photos, logos, trademarks and images of people. Do not upload material you do not have rights to.

7. AI-generated content

1. 1.Outputs are generated by AI and may be inaccurate, incomplete or different from your actual product. Review every Output before you publish it — especially prices, effects, ingredients, claims, sizes and legal notices.
2. 2.You are responsible for how you use Outputs, including compliance with advertising, consumer protection and marketplace rules where you sell. Images the service generates are labeled as AI-generated where required.
3. 3.The service checks some Outputs against channel rules and your banned-word list, but these checks are aids, not a guarantee of legal compliance.

8. Acceptable use

You must not use the service to create, upload or distribute:

1. 1.content that infringes someone else's intellectual property, privacy or publicity rights, including using a real person's likeness without permission;
2. 2.false or misleading claims about products, including unapproved health or medical claims;
3. 3.sexual content, content involving minors in any sexual context, violent or hateful content, or content that harasses anyone;
4. 4.content promoting illegal products or services, weapons, drugs, gambling or other goods restricted by law or by the marketplaces you sell on;
5. 5.deepfakes, impersonation, spam, malware, or content designed to deceive.

9. Prohibited conduct

1. 1.Do not try to access other users' data, reverse engineer the service, scrape it, or bypass usage limits or credit charges.
2. 2.Do not resell or share access to your account, or create multiple accounts to obtain free credits.
3. 3.We may suspend or limit an account that breaks these Terms, and remove content that breaks Section 8. If we terminate a paid account for a reason other than your breach, we will refund the unused part of the current period.

10. Storage of files

Files you create are kept in your library for the storage period shown in your account. We may delete files after that period; download anything you want to keep. Deleting your account deletes your files and cannot be undone.

11. Disclaimers and limitation of liability

1. 1.The service is provided "as is". We do our best to keep it available and accurate, but we do not guarantee that it will be uninterrupted or error-free, or that Outputs will achieve any particular sales result.
2. 2.To the extent permitted by law, we are not liable for indirect or consequential losses, lost profits or lost data, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.
3. 3.Nothing in these Terms limits liability that cannot be limited by law, or any rights you have as a consumer under the mandatory law of your country.

12. Changes to these Terms

We may update these Terms. We will post the new version on this page and, for material changes, notify you by email at least 30 days before they apply. If you do not agree, you can cancel before the change takes effect.

13. Governing law and disputes

These Terms are governed by the laws of the Republic of Korea. Disputes will be handled by the Seoul Central District Court, unless the mandatory law of your country gives you the right to bring a claim in your local courts.
